These Terms govern your use of DarkMetalDesigns.com, purchases made through the site, and your interaction with Dark Metal Designs.
ABOUT THESE TERMS
Dark Metal Designs is operated by AchievMo Consulting LLC. References to “Dark Metal Designs,” “Dark Metal,” “we,” “us,” or “our” in these Terms refer to the business operating this website and offering the applicable products, content, events, and services.
These Terms apply to DarkMetalDesigns.com and to purchases or interactions made through the site. Additional terms may apply to specific products, pre-orders, events, promotions, restricted content, or related services. If a specific product or policy contains different terms, the more specific terms control for that transaction.
USE OF THE SITE
You may use the site for lawful personal or business purposes. You agree not to interfere with the site, attempt unauthorized access, misuse checkout or payment systems, scrape or reproduce site content for commercial use without permission, submit fraudulent information, or use the site in a way that violates applicable law.
We may suspend or restrict access to the site where reasonably necessary to protect the site, our customers, our systems, or our business.
PRODUCTS, IMAGES & LISTINGS
We try to describe products accurately, but colors, packaging, finishes, artwork placement, manufacturer packaging, and other visual details may appear different depending on screens, production variation, or supplier changes.
Product availability is not guaranteed until an order is accepted and fulfilled. We may correct pricing, description, inventory, or listing errors when discovered.
Limited-run, custom, collectible, and specialty products may vary slightly from photographs or prototypes. These ordinary production differences are not necessarily defects.
ORDERS & PAYMENT
When you submit an order, you are offering to purchase the listed products at the price and terms presented during checkout. Payment may be authorized or collected at checkout depending on the product and payment method.
We may reject, limit, or cancel an order for reasons including suspected fraud, pricing or inventory errors, payment failure, quantity restrictions, shipping restrictions, product unavailability, or other legitimate business reasons.
If we cancel a paid order and do not ship the applicable merchandise, we will issue the appropriate refund to the original payment method.
PRE-ORDERS
Pre-order products are not currently ready to ship. Unless the listing states otherwise, payment is collected at checkout to reserve the item.
Manufacturer, distributor, production, freight, customs, and release schedules can change. Any arrival or release date shown for a pre-order is an estimate rather than a guaranteed delivery date.
If a manufacturer, distributor, or supplier cannot provide the ordered quantity, we may cancel the affected portion of the order and issue a refund. If a material delay occurs, we will provide any options required by applicable law, which may include agreeing to the revised timing or canceling the affected order for a refund.
Customer-requested pre-order cancellations may be declined once inventory has been committed. Where cancellation is accepted and permitted by law, a 20% cancellation fee may apply to cover committed inventory, processing, payment, and administrative costs.
Any separate Pre-Order Policy or terms shown on a product page or during checkout are incorporated into these Terms.
SHIPPING & DELIVERY
Shipping estimates are not guarantees. Carrier delays, weather, address issues, supplier delays, and other circumstances outside our control may affect delivery timing.
You are responsible for providing an accurate and deliverable shipping address. Additional charges caused by an incorrect or incomplete address may be the customer’s responsibility where permitted by law.
When an order cannot be shipped within the required or promised timeframe, we will handle delay notices, customer consent, cancellation, and refunds as required by applicable law.
RETURNS, CANCELLATIONS & REFUNDS
Return, exchange, cancellation, and refund eligibility may vary by product type. Any specific policy displayed on the applicable product page, at checkout, or in a separate Shipping & Returns policy becomes part of these Terms.
Customers should inspect delivered items promptly and contact us regarding damaged, incorrect, or materially defective merchandise within the timeframe stated in the applicable policy.
Nothing in these Terms eliminates any refund, replacement, cancellation, or other consumer right that cannot legally be waived.
COLLECTIBLES, CHASES & RANDOM VARIANTS
Collectible products may include chase versions, random variants, assortment differences, packaging variations, or other manufacturer-created differences.
No chase, rare version, specific assortment, packaging variation, or special variant is guaranteed unless the product listing expressly says it is guaranteed.
For sealed cases, assortments, blind items, and manufacturer-packed products, contents may be determined by the manufacturer rather than Dark Metal Designs.
EVENTS, VENDOR SPACES & TICKETS
Event registrations, vendor spaces, tickets, tables, sponsorships, and event-related purchases may be subject to additional event-specific rules regarding payment, setup, conduct, cancellations, refunds, venue restrictions, and event changes.
Those specific event terms control where they differ from these general Terms.
DARK METAL AFTER DARK — 18+
Dark Metal After Dark contains mature themes and content intended only for adults. By entering an area marked 18+, you represent that you are at least 18 years old and legally permitted to access that content where you are located.
Use of After Dark is also subject to the separate 18+ Policy posted on the site.
INTELLECTUAL PROPERTY
Unless otherwise stated, the Dark Metal Designs name, branding, original site graphics, layout, written content, original artwork, photographs, product designs, and other original materials created by or for Dark Metal Designs are protected by applicable intellectual-property laws.
You may not copy, reproduce, sell, distribute, modify, or commercially exploit our original content without permission, except as allowed by law.
Third-party trademarks, vehicle names, manufacturer names, characters, brands, logos, and other intellectual property referenced on the site remain the property of their respective owners. Their appearance on the site does not by itself mean that the third party sponsors or endorses Dark Metal Designs.
RELATED & THIRD-PARTY SITES
The site may link to related properties such as DarkMetalDiecast.com as well as payment processors, social networks, carriers, vendors, manufacturers, or other external websites.
Separate sites and third-party services may have their own terms and privacy policies. We are not responsible for the content, availability, or practices of unaffiliated third-party websites.
DISCLAIMERS
The site and its content are provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, permanent availability of any particular product, or that every piece of site content will always be current.
Collector commentary, product opinions, market observations, estimated values, demand discussions, and similar content are informational and subjective. They are not guarantees of future value, resale price, rarity, demand, or investment performance.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Dark Metal Designs and AchievMo Consulting LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site, inability to use the site, delays, loss of data, third-party services, or purchases made through the site.
Where liability cannot legally be excluded or limited, these Terms do not attempt to exclude or limit that liability beyond what applicable law permits.
INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the site, your violation of these Terms, or your infringement of another party’s rights.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida and applicable federal law, without limiting any non-waivable consumer protections that may apply to you.
CHANGES TO THESE TERMS
We may update these Terms as the business, website, products, services, or applicable requirements change. The effective or updated date at the top of this page will identify the current version.
Your continued use of the site after updated Terms become effective means the updated Terms apply to future use and transactions, subject to applicable law.
